Council of Europe Anti-Torture Committee visits San Marino


15.02.2005 - A delegation of the Council of Europe's Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) carried out a visit to San Marino from 8 to 11 February 2005. It was the Committee's third periodic visit to San Marino.

During the visit, the delegation followed up the recommendations the CPT had made after the visits in 1992 and 1999, in particular, as regards the conditions of detention at San Marino Prison and the safeguards offered to persons detained by law enforcement agencies. Further, it examined in detail the procedures for involuntary hospitalisation and “obligatory medical treatment” (TSO) of psychiatric patients. For the first time in San Marino, the delegation also visited two homes for the elderly.

In the course of the visit, the delegation held consultations with Mr Fabio BERARDI, Minister for Foreign Affairs and Justice, Mr Pier Marino MULARONI, interim Minister for the Interior, Mr Gian Carlo VENTURINI, Minister for the Territory, and Mr Massimo Roberto ROSSINI, Minister for Health and Social Affairs. The delegation also met senior officials from the relevant Ministries as well as representatives of judicial authorities.

At the end of the visit, the delegation was received by the two Captains Regent of the Republic of San Marino, Messrs Giuseppe ARZILLI and Roberto RASCHI.

The visit was carried out by the following members of the CPT:

    -     Roger BEAUVOIS, Head of Delegation (French)
    -     László CSETNEKY (Hungarian)
    -     Asya KHACHATRYAN (Armenian)
    -     Petros MICHAELIDES (Cypriot).

They were supported by Michael NEURAUTER and Caterina BOLOGNESE of the CPT's Secretariat, and assisted by an expert, Daniel GLEZER, psychiatrist, former Head of Prison Psychiatry at the Regional Medical Psychological Department at "Les Baumettes" Remand Prison, Marseille, France.

The delegation visited the following places:

    -     San Marino Prison

    -     Headquarters of the Gendarmeria
    -     Headquarters of the Police

    -     Neuro-psychiatric Service at the General Hospital of San Marino
    -     Home for the Elderly of the Republic of San Marino
    -     “Villa Oasi” Home for the Elderly.
