Council of Europe Anti-Torture Committee visits Romania


23.06.2006 - A delegation of the Council of Europe's Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) carried out a visit to Romania from 8 to 19 June 2006. It was the CPT's seventh visit to this country.

During the visit, the delegation reviewed the measures taken by the Romanian authorities following the recommendations made by the Committee after its previous visits. In this connection, particular attention was paid to the treatment of persons detained by the police and the conditions of detention in a number of police establishments and detention facilities for foreign nationals. The delegation also examined in detail various issues related to prisons, especially the regime and security measures applied to life-sentenced prisoners and other prisoners classified as “dangerous”. In the course of the visits to a psychiatric hospital and a medical-social centre, it looked into the legal status of patients/residents and the placement procedures.

The delegation held meetings with Monica MACOVEI, Minister of Justice, Alexandru MIRCEA, State Secretary of the Ministry of Administration and the Interior, and Virgil PĂUNESCU, State Secretary of the Ministry of Public Health. Further, it held consultations with senior officials from the Ministries of Justice, Administration and the Interior and Public Health, as well as from the Ministry of Labour, Social Solidarity and Family. It also met with Ioan MURARU, People's Advocate, and Dragoş NESTOR, First Prosecutor at Bucharest Criminal Court.

At the end of the visit, the delegation presented its preliminary conclusions to the Romanian authorities.

The visit was carried out by the following members of the CPT:

    -     Vladimir ORTAKOV (citizen of "the former Yugoslav Republic of Macedonia")
    -     Tatiana RǍDUCANU (Moldovan)
    -     Pierre SCHMIT (Luxemburger).

They were supported by Michael NEURAUTER and Johan FRIESTEDT of the CPT's Secretariat, and assisted by two experts: Eric DURAND, former Head of the Medical Services at Fleury-Mérogis Prison, France, and Timothy HARDING, Director of the University Institute of Forensic Medicine, Geneva, Switzerland.

The delegation visited the following places:

Police establishments

    -     Detention facilities at Bacău County Police Headquarters (Bacău County)
    -     Detention facilities at Bucharest Municipal Police Station No. 13
    -     Detention facilities at Câmpina Municipal Police Headquarters (Prahova County)
    -     Detention facilities at Craiova County Police Headquarters (Dolj County)
    -     Detention facilities at Oradea County Police Headquarters (Bihor County)
    -     Beius Police Station (Bihor County)

    -     Otopeni Detention Centre for Foreigners
    -     Holding facilities for foreigners in the transit zone at Bucharest-Otopeni International Airport

The delegation also went briefly to Bucharest-Baneasa International Airport and the Reception Centre for Asylum-Seekers at Bucharest-Otopeni International Airport, in order to examine the conditions under which foreign nationals may be held there.

The delegation also paid a brief visit to Nucet Psychiatric Hospital, in order to examine involuntary placement and review procedures.

    -     Holding rooms at Piatra-Neamt Criminal Court.
