Council of Europe Anti-Torture Committee visits Malta


27.01.2004 - A delegation of the Council of Europe's Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) carried out an ad hoc visit to Malta from 18 to 22 January 2004. It was the Committee's fourth visit to that country. Three periodic visits took place in 1990, 1995 and 2001.

The main purpose of the visit was to examine the treatment of foreign nationals detained under the immigration legislation, as well as the procedures and means of restraint applied in the context of forcible removals by air.

The delegation visited the following places:

Police establishments

    -     Police Headquarters, Floriana 
    -     Ta'kandja Police Complex, Siggiewi
    -     Malta International Airport Custody Centre, Luqa 
    -     Immigration Reception Centre, Hal Far

Military establishments

    -     Lyster Barracks, 1st Regiment of the Armed Forces, Hal Far 
    -     Safi Barracks, 3rd Regiment of the Armed Forces, Safi

The delegation also went to Corradino Correctional Facility, as well as Mount Carmel Psychiatric Hospital and St Luke's Hospital, in order to interview foreign detainees and to consult specific medical files.

The visit was carried out by the following members of the CPT:

    -     Mauro PALMA (Head of Delegation) (Italian) 
    -     Ioanna BABASSIKA (Greek) 
    -     Eugenijus GEFENAS (Lithuanian).

They were assisted by Catherine PAULET, Psychiatrist, Regional Medical and Psychological Service, Baumettes Prison, Marseille, France (expert) and supported by Fabrice KELLENS, Head of Unit, and Edo KORLJAN of the CPT's Secretariat.

In the course of the visit, the delegation held meetings with Tonio BORG, Minister for Justice and Home Affairs, Joseph SAMMUT, Ombudsman, Charles BUTTIGIEG, Commissioner for Refugees, John RIZZO, Commissioner of Police, and Colonel Carmel VASSALLO, Deputy Commander of the Armed Forces of Malta. In addition, it met a number of senior officials from the Ministry of Justice and Home Affairs, as well as from the Armed Forces of Malta.
