New visit of the Council of Europe Anti-Torture Committee to the Transnistrian region of Moldova


24.03.2006 - A delegation of the Council of Europe's Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) carried out a visit to the Transnistrian region(*) of the Republic of Moldova from 15 to 20 March 2006.

It was the CPT's third visit to the Transnistrian region, the previous visits having taken place in November 2000 and March 2003. One of the aims of this new visit was to evaluate the situation of prisoners suffering from tuberculosis. In this context, the delegation examined the concrete results of a project aimed at improving the living conditions of such prisoners. This project, implemented by Caritas Luxembourg, has been financed with funds from the Council of Europe. The delegation also examined the treatment of other categories of prisoners.

The CPT’s delegation enjoyed full cooperation from the local authorities, which granted access to all places of detention  the delegation wished to visit. The delegation visited Prison N° 1 (Glinoe), Colony N° 2 (Tiraspol) and the remand section of Colony N° 3 (Tiraspol) and was able to meet in private all prisoners whom it wished to interview.

The delegation also made a follow-up visit to Prison N° 8 in Bender. This prison, located in the Transnistrian region, is part of the prison system of the Republic of Moldova. Visited by the CPT in November 2003 and February 2004, the establishment continues to be deprived of running water and electricity due to a decision by the Bender municipal authorities. Further, since 2005, the prison has been disconnected from the sewage disposal system.

The delegation held meetings with the local authorities in Tiraspol. At the end of the visit it met, in Chişinău, with the Deputy Minister of Justice, Nicolae EŞANU and the Director General of the Penitentiary Insitutions, Vladimir TROFIM, as well as with representatives of the prison administration and the Prosecutor General’s Office.

The visit was carried out by three members of the Committee: Jean-Pierre RESTELLINI, a Swiss specialist in forensic and internal medicine (Head of Delegation); Andres LEHTMETS, an Estonian psychiatrist and Second Vice-President of the CPT; Pierre SCHMIT, a prosecutor from Luxembourg. They were assisted by Cyrille ORIZET, psychiatrist, Georges Pompidou European Hospital, Paris, France (expert) and Geneviève MAYER, Deputy Executive Secretary of the CPT.

(*) The Transnistrian region unilaterally declared itself an independent republic in 1991. Negotiations aimed at resolving this situation are still taking place.
