Council of Europe anti-torture Committee visits Denmark


Strasbourg, 26.02.08 – A delegation of the Council of Europe's Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) carried out a periodic visit to Denmark from 11 to 20 February 2008. It was the CPT’s fourth periodic visit to Denmark.

The CPT’s delegation reviewed the measures taken by the Danish authorities to implement the recommendations made by the Committee after previous visits. The delegation examined in detail various issues concerning detention by the police, as well as the detention of asylum-seekers and other foreigners in the Ellebæk Establishment. As regards prisons, particular attention was paid to the treatment of maximum security prisoners. In the Herstedvester Establishment, the delegation focused on the treatment of sexual offenders who were receiving, or had been offered, anti-hormone therapy, as well as on the situation of prisoners from Greenland. In addition, the delegation visited two psychiatric establishments, where it examined in particular the legal safeguards afforded to patients in the context of the use of restraint. The delegation also visited two secure institutions for minors and juveniles.

The delegation had consultations with Ms Lene ESPERSEN, Minister of Justice. It also met with: Mr Lars HJORTNÆS, Deputy Permanent Secretary of State, Ministry of Justice; Mr Mogens HENDRIKSEN and Mr Hans-Viggo JENSEN Deputy National Commissioners, Danish National Police; Mr William RENTZMANN, Director-General, Danish Prison and Probation Service and Ms Annette GJERRIS, Director General, Psychiatry Department, Regional Council of the Capital Region of Denmark.

The delegation also met with Mr Hans GAMMELTOFT-HANSEN, the Parliamentary Ombudsman. Further it had meetings with representatives of non-governmental organisations active in areas of concern to the CPT.

At the end of the visit, the delegation presented its preliminary observations to the Danish authorities.

The visit was carried out by the following members of the CPT:

They were supported by Petya NESTOROVA (Head of Division) and Kristian BARTHOLIN of the CPT's Secretariat, and assisted by two experts: James McMANUS, Professor of Criminal Justice at Glasgow Caledonian University (United Kingdom) and Tatjana SIMMINS, psychiatrist, former Senior Registrar at the Medical Services of Champ-Dollon Prison (Switzerland).

- Bakkegården (Nykøbing Sjælland)
- Sønderbro (Copenhagen)

Establishments for the detention of foreigners

- Ellebæk (formerly “Sandholm”) Prison and Probation Establishment for Asylum-seekers and Others Deprived of their Liberty
